GENERAL RENTAL TERMS AND CONDITIONS OF THE FINNISH CAR RENTAL ASSOCIATION
St. From 27.11.2002 In these conditions the term car hire means the lessor and the term renter means the lessee.
1. CAR USAGE
a) The renter is obliged to take care of the car as well as a careful person takes care of his/her own car and to observe special carefulness and cautiousness while driving. The renter agrees to use the car only in the manner it is normally intended for.
b) The renter agrees to drive the car himself/herself. He/she is not allowed to hand over the car to other persons nor for their use without such permission being explicitly noted in the rental agreement. The renter (driver) shall possess a valid driving licence and have at least one year´s driving experience. Further he/she shall fulfil the age requirements of the car hire. The renter is obliged to inform the person to whom he/she hands over the rental object within the scope of this agreement, about the contents of this agreement.
c) Usage of the car for illegal purposes, towing, competitions or training for these, educational driving, and driving on ice outside officially marked ice roads is prohibited.
d) Whenever the car, even momentarily, is left parked, it necessarily is to be locked.
e) As the car hire hands over the car to the renter, both parties should check the visible condition of the car in order to avoid possible disputes regarding the time of appearance of damages.
2. RESPONSIBILITY FOR THE CAR AND ITS EQUIPMENT DURING THE RENTAL PERIOD
2.1 Basic retention of the renter
The renter is, up to the upper retention limit specified in the agreement:
a) Obliged to compensate during the rental period occurred damages to the car or to its accessories
b) Obliged to compensate parts and accessories which have disappeared from the car during the rental period
c) Obliged to pay cleaning costs arising from unusual contamination of the car. (Smoking and transportation of pets require permission from the car hire).
d) Obliged to pay the daily fee defined in this agreement for the lay days caused by the accident, however for a maximum of 30 days. The lay days begin at the date of the accident
e) Obliged to pay any damages caused to the windshield such as hits of a rock, which have caused a crack or a hole.*
2.2 Reducing/eliminating the retention of the renter
The renter can reduce or eliminate his/her retention by paying a special retention reduction/elimination fee. However, the retention reduction/elimination fee does not cover damages due to the following or similar reasons:
* excessive loading, displacement or detachment of the load
* upholstery damages caused by tobacco smoking or gashing
* driving with empty tires
* snow damages if indicated by signs (dropping of snow from roofs)
* driving in too narrow premises considering the dimensions of the car
* driving of road or in areas not intended for car driving
The car hire may, at its discretion, abstain from granting the retention reduction.
2.3 Liability of the renter for all damages
The renter is obliged to compensate the entire damages to the car hire providing the damages caused to the car or the car hire are intentional by the renter, caused by an act of negligence, caused during usage of the car under influence of alcohol or other narcotic agents, for criminal purposes, or caused due to the renter not complying with the conditions in this agreement.
2.4 Releasing of the renter from his/her indemnification liabilities
The renter is released from the above mentioned indemnification responsibilities providing that the car hire is fully indemnified for its damages through an insurance, or from the opposite sides traffic insurance or from the person who caused the damages.
2.5 Other payment liabilities
The renter is obliged to pay the parking, overload penalty fees and other charges levied on the car hire on the basis of holder´s liability.
a) At the beginning of the rental period the car hire is entitled to request a reasonable deposition according to the prevailing price list, or a sum corresponding to the estimated rent as well as an open credit card imprint, based on which the car hire is entitled to invoice all the undisputed fees specified by this agreement, however, complying with the rules of the credit card company. The car hire may require that the lessee must have two credit cards which together function as collateral for the rent payment.
b) The renter agrees to pay the rental based on this agreement and calculated according to the principles of this agreement 30 days prior to pick-up date.*
c) Other forms of payment may be agreed at the beginning of the rental period by noting them in the rental agreement. If the person or corporation specified as renter does not pay the rental sum, the person who signed the agreement is responsible for the payment of the rental sum.
4. LIABILITIES OF THE CAR HIRE
The car hire is obliged to hand over the car to the renter in working order and complying with applicable laws, at the time and place agreed when the reservation was made. Further the car hire is obliged to give the renter sufficient guidance and instructions about the usage of the car. Unless the renter receives the car for his/her usage according to the reservation, he/she can demand a reduction of the rent corresponding to the error, or cancel the agreement.
The renter can demand indemnification for the damages caused by the delay.
5. MILEAGE INDICATOR
a) The distance driven is measured with the mileage indicator belonging to each vehicle. If the renter has damaged the mileage indicator or its seal, he/she is obliged when returning the car to pay the rent corresponding to the mileage estimated by the car hire, however, unless either party proves probable that the car has been driven a longer/shorter distance.
b) The renter is obliged without delay to inform the car hire about possible malfunction of the mileage indicator.
6. FUEL, SERVICE, AND MAINTENANCE
The renter pays for the fuel needed. The car hire is to inform the renter the correct quality fuel to be used. The renter is liable for damages caused by usage of incorrect quality fuel. During the rental period the renter is responsible for taking care of normal car maintenance, such as e.g. the engine oil quantity, the radiator and battery fluids, the tire pressures, etc.
7. ACTIONS OF THE RENTER IN CASES OF MALFUNCTION, DAMAGE, AND THEFT
a) The renter shall immediately inform the car hire about malfunctions appearing in the car or about damages to the car as well as about theft. The police shall immediately be informed about theft. Subsequently the car hire shall inform the renter about the actions to be taken because of the incident. However, without informing the car hire the renter is entitled to have the car repaired for a maximum value of 50 euros, provided it is necessary for continued driving. In such cases the renter shall acquire a report from the repair company detailing the performed repair actions and the payment.
b) In traffic accident cases the renter is always obliged immediately to submit a damage report to the car hire. The report is to be written on the accident report form available in the car. In cases of unclear culpability the renter shall inform the police. The police is always to be informed in cases of personal injury. The police is always to be informed about deer accidents by the renter, who also has to submit to the car hire a certificate given by the police and stating the notification.
c) If the renter neglects the above mentioned notifications, he/she is liable towards the car hire for possible damage caused by this negligence.
8. LIABILITY OF THE CAR HIRE FOR DEFECTS IN THE CARIf a technical or other fault of the car appears during the rental period, the renter can demand it to be fixed or demand a corresponding reduction of the rent. If the fault is substantial, the renter can demand that the agreement is cancelled. However, the agreement cannot be cancelled if the car hire replaces the car within a reasonable time period. The renter can demand indemnification for the damages caused by the fault.
9. RETURNING OF THE CAR UPON THE EXPIRATION OF THE AGREED RENTAL PERIOD
a) The car is to be returned to the agreed place upon expiration of the agreed rental period. Alterations of either the place or the date are to be agreed with the car hire with sufficient notice. The rental period according to the agreement expires when the car has been returned to the car hire, or when the car hire has received a notification from the renter stating that the car has been returned to a place approved by the car hire.
b) If the car has not been returned upon the expiration of the rental period and no continuation of the rental period has been agreed, the police will be informed.
c) If the renter neglects his/her liabilities according to item a), the car hire is entitled to charge a reasonable indemnification for the economical losses caused by the negligence.
10. RETURNING OF THE CAR BEFORE THE EXPIRATION OF THE AGREED RENTAL PERIOD*
If the renter returns the car before the expiration of the agreed rental period, the rental sum is determined according to the agreement and based on the agreed usage period. Therefore, rentee is not liable to return any portion of paid rental to renter.* Provided the car has been rented on special conditions, the rent is determined according to the normal price list.
11. TERMINATION OF THE AGREEMENT
The car hire is entitled to terminate this agreement during the rental period provided it appears that the renter violates this agreement or that the renter, according to the estimation of the car hire, is unable appropriately to handle the car. If usage of the car is discontinued due to accident or theft, the agreement is terminated upon the car hire having received notification hereof. When the car hire terminates the rental agreement, the renter is obliged immediately to return the car to the car hire.
12. CROSSING THE FINNISH BORDER
Crossing the Finnish border with the car is prohibited without a written permission by the car hire. The car hire decides about the possible granting of the permission on a case by case basis at its discretion.
13. CONFLICTS RELATED TO THE AGREEMENT
Unless the conflict can be solved through negotiations between the two parties. If the conflict is subjected to court judgement, legal action is to be taken in the district court at the domicile of the car rental company.
*These conditions may have been altered in this manual. Hence, Touring Cars conditions supersedes general conditions. Touring Cars has added the section 2.1.E. and changed the sections 3.B. and 10.. Renter accepts these changes by his or hers signature.
Driver's License
Driver's License
A valid driver´s license is required for all rentals. Driver must have held a driver´s license for driving passenger cars for at least one year.

Primary driver will be added to the Rental Agreement by Touring Cars sales office. The office will add the name, which was given upon reservation, to the Rental Agreement. This individual must hold a valid driver´s license, be over 18 years of age, present an acceptable credit card (debit cards not accepted), have held the driver´s license for driving passenger cars for at least one year.

Individuals not automatically covered on the Rental Agreement, as Authorized Operators, need to be approved by Touring Cars staff before adding them on the agreement. The extra driver payment has to be paid at the latest at the pickup.

Renter and each additional authorized operator must be present to sign Rental Agreement, present an acceptable credit card (debit cards not accepted), show valid driver´s license, and must be a minimum of 18 years of age, he or she must have also held the driver´s license for driving passenger cars for at least one year. Additional authorized operator can be added without credit card number if the Primary Driver takes the responsibility for the accidents and damages up to the deductible.
Pick-up & Drop-off Policy
Pick-up & Drop-off Policy
All rental vehicles shall be picked-up and dropped-off according to appointment set upon booking. Our Sales Office will ask you to state your pick-up and drop-off times, when you book your holiday. You can change these times up to 24-hours before scheduled times. However, Touring Cars reserves the right to all changes, and we do not guarantee any changes after you have received your booking confirmation.
You do not have to wash the exterior of your rental vehicle. However, according to our rental conditions, you need to perform few tasks before returning the rental vehicle. Please check that the following tasks have been done before drop-off:

Empty trash cans in vehicle and shake all rugs.

Empty grey water and toilet tank.

Check that both gas bottles are full or otherwise we charge 50 € per bottle at drop-off.

Fill up Diesel tank of vehicle.
If you wish not to perform these cleaning related tasks, you can purchase Final Cleaning, which includes first two items on the list. The price of this service is 149 euros per rental. In addition, you can purchase Diesel Refuelling Service, which cost 13 euros plus diesel charge stated at the pump. This way you do not have to worry if the tank is full upon drop-off.

Breakdown
Client is responsible informing Touring Cars rental station immediately upon discovering a technical malfunction. Failure to do so will erase a possibility of refund. Moreover, client is required to travel to the closest repair store to get the discovered problems fixed. The customer is responsible for checking engine oil, fluids, and coolant levels at each refueling, as well as reporting mechanical failures immediately. Instructions and procedures for maintenance expense reimbursement are provided at rental. Customers may be held responsible for mechanical damage due to negligence in vehicle operation or failure to provide normal maintenance. In the event the vehicle is in breakdown repair for 24 hours or more, through no fault of the customer, our responsibility to customer is limited to refund of daily rate or portion thereof. Radio, refrigerator, appliances, cruise control, and generator malfunctions are not considered breakdowns and no refunds are available for repair time to these items.
Disputes
If a Tour Operator makes an error in its Advertising materials, they take full monetary liability of the mistake. If the mistake has been in Touring Cars' marketing materials, Touring Cars accepts the monetary loss, and grants any services that have been promised to a client. All disputes are settled according to Finnish laws. Rental customers approve this by signing a rental agreement, which indicates the following: "By this signature, a rental accepts the terms written on the other side of this contract and acknowledges the liability for all parking and traffic violations". All post-rental charges will be executed after a client approves the charges on a damage form.

Primary driver will be added to the Rental Agreement by Touring Cars sales office. The office will add the name, which was given upon reservation, to the Rental Agreement. Touring Cars rental stations are open 24 (Twenty Four) hours 7 (seven) days a week by apppointment only.

Pick-up and drop-off times have to be informed upon booking, or it will not be confirmed.

Touring Cars needs exact pick-up and drop-off times. In addition, flight numbers have to informend for all rentals that include airport pick-up service.

If a client does not comply with pick-up or drop-off time, Touring Cars reserves a right to charge 50 € per hour for each hour that a client is late.

The Client has to give a minimum 24-hour notice of being late or the surcharge will be issued. However, Touring Cars has to approve any changes in returning time. Touring Cars may charge, in addition to the above mentioned fee, possible monetary losses from the client who was late, if their being late delays the next rental of the rental vehicle.

There is a night surcharge of 79 € if the customer service is between 23.00 - 05.00 (11pm - 5 am)

General Penalties

The vehicle must be returned with empty waste water tank and lavatory cassette. Also, vehicle has to be moderately clean inside. Failure to comply will entail a cleaning surcharge of 150 € and labor charge of 60 € per hour.

Smoking is prohibited in the camper, we will charge 850 € if this rule is broken.

Animals are not allowed in the campers, the penalty fee is
400 €. -
If a client does not comply with returning time, Touring Cars reserves a right to charge 50 € per hour for each hour that a client is late. Traffic Regulation Penalties
All traffic fines resulting from violation of the traffic regulations are for renter´s account. Traffic Fines: Tickets and subsequent administrative sanctions resulting from traffic violations incurred during the rental period are charged to the client. Touring Cars reserves the right to charge the renter for any fines and administrative fees.

The customer is liable for all penalties for offences committed under traffic regulations including, but not restricted to, road tolls, parking orders or prohibition, clamping fines, congestion charges, compound charges, bus lane fines, speeding fines or any other laws or regulations incurred during the period of rental and the Renter accordingly indemnifies the Touring Cars against all such liability!

Local authorities may use cameras to automatically detect if a driver breaks traffic regulations. Moreover, all violation fines, including parking tickets, will be collected by local authorities!

If we are required to pay fines, mentioned hereinabove, or associated costs, customer agrees that we may charge him or her with the amount of any fine plus a € 20, inc. VAT, administration charge per fine for dealing with these matters. Touring Cars will automatically pay for any fines that a renter accumulates during the car rental period, but will then proceed to charge the customer´s credit card for the total cost.

Driver authorizes Touring Cars to charge his or her credit card, up to 24 months after rental period, for all traffic penalties issued by local authorities and for administrative fees.
Cancellation Policy

In case of cancellation of confirmed reservations, charges will be billed as follows:

Minimum of 200 € will be charged if a confirmed booking is cancelled.

Departure day or no-show 100 %
Please note that if a payment is not made, when you make the cancellation, the cancellation fees are subject to collection activities. These fees can be charged by the clients credit card, if not paid by a client / an agent, which booked the camper.
Cancellation fee will be a percentage of the total amount of an invoice, which includes base charge, rental days, one-way fees, extra items, etc. Please note that all changes in a valid booking are subject to cancellation policy.
Travel Insurance
Travel Insurance
Traveller's insurance is an insurance providing cover in the event of an accident that occurs or an illnesses that breaks out during a trip. In addition, the insurance covers cancellation and curtailment of a trip, and a missed or delayed departure.
Children and grandchildren are included in your traveller's insurance
Each family member needs a separate traveller's insurance but, as an exception, those family members and grandchildren who are under 15 years of age and who travel with the insured are included in a parent's or grandparent's insurance.
Choose the cover types you need
Traveller's insurance always includes medical expenses cover. You may supplement the cover by a

- Death benefit
The medical expenses cover includes compensation for treatment expenses in the event of travel-time accident or travel-time illness, as well as for a cancelled or curtailed trip or for a delayed departure .
Compensation under traveller's insurance is paid without a deductible for trips of a maximum of three months.

Winter conditions
Winter conditions
We would like to inform you about the necessary steps that have to be made to ensure you a convenient travel experience.
The winter tires are mandatory in Scandinavia during 01.12 - 28.2 and during this period all our rental vehicles have winter tires.
The customer can have winter tires also beside this period but then we charge 60 € to change the tires plus 5 € /each rental day for the use of the tires.
Motorhoming during winter
Always, when you are not driving, cover the windshield and driving cabin side windows with the insulation cover included in your vehicle. This improves thermal insulation and prevents the loss of heat from living area through the driving cabin.
Close the curtains of the sunroofs to prevent heat loss through them.
Side windows have double structure with air in between them working as insulation, so covering them is not necessary.
Use engine block heater always for at least 1 hour before starting the engine during cold weather. The connector for block heater cable is located at front bumper and the cable can be found inside the vehicle.
When the car is being heated, the engine of the warm air blower uses a lot of electricity. Ensure that there is enough electric power and keep the car connected to electricity grid with included electric cable always when it is possible.
Fresh water system
If the water tank of the car has been filled, it is imperative to ensure that heating of the car is turned on all the time to prevent freezing of the water system. Remember to keep the car heated even if you are not staying in it overnight. Keep the car connected to electricity grid with included electric cable to ensure that the battery power does not run out during the night. Check also that gas bottle has enough gas left in it for continuous heating. Rental client is responsible of keeping the car
heated.
If the water system freezes, it will damage the water pump and crack facets as well as connections of the water pipes. Total damages will easily exceed 1000 Euros. Insurance does NOT cover damages that happen due to freezing.
In case the car cannot be heated, the water system must be emptied correctly: water tank and water boiler must be emptied, the fuse of the water pump must be disconnected, all the facets must be left open in a middle position (between cold and warm), the emptying valves of the piping must be opened and the shower hose must be left on the floor. Leave everything open in these positions.
Grey water system
Grey water tank is located outside of the vehicle, which means it is not in a heated space. Therefore in winter time the emptying valve of the grey water tank must be kept open all the time, so that water flows straight out of the tank instead of freezing in it and damaging the tank and valve.
Toilet cassette
The emptying cassette is located in a heated space and does not freeze as far as the car is being heated. Remember to empty the cassette before leaving the car unheated.
